His Lies regarding his experience are a disgrace and a gross insult to the true victims that went through the Horrors of Cyclone Tracy which devastated Darwin on Christmas Day in 1974 and in which took 71 lives.

It is ironic that such a man who holds such a position in society and plays the "victim" role so often is the same man who reverted to physical violence towards his family on a daily basis, and to this day still wonders why he is estranged and fails to acknowledge his past....

A RAYMOND Terrace woman who ripped off $100,000 from the Australian Tax Office used part of her share of the proceeds to pay for her wedding, Newcastle District Court heard yesterday.

Annette Bertram, 36, lodged 28 fraudulent business activity statements for two companies between 2001 and 2005, Judge Linda Ashford said.

Bertram, of Brown Street, received GST refunds totalling $105,000, but told the court that her share of the money was about $25,000.

Bertram pleaded guilty to five counts of obtaining a financial benefit by deception and was sentenced to two years' jail with a non-parole period of one year.

Judge Ashford said Bertram, who was receiving Centrelink benefits at the time, used the money to pay living expenses and for her wedding.

Bertram told the court that she was threatened by her father and brother, who forced her to prepare and sign the statements before lodging them with the tax office.

The statements contained fraudulent transactions such as buying cattle, cars and a machinery shed that did not exist, Judge Ashford said.

The tax office audited the two companies after Bertram rang the office to inquire about a refund in 2005.

Judge Ashford said that Bertram came from a dysfunctional family and wanted no further contact with her father and brother.

Bertram told the district court that she intended to pay the money back after she had served her jail sentence.

Cessnock City Council Mayor Alison Davey provided a character reference for Bertram and attended yesterday's hearing.

George Donnelly, President of the Cairns Lone Fathers Association knows first hand, the hardships men endure when going through separation.

It’s a truism to say there are no winners in a divorce.
Men in particular are often hit hard, dealing with loss, separation and courts which many men say rules in the favour of women.
Some men, faced with these challenges, give up the fight.
George Donnelly, President of the Cairns branch of the Lone Fathers Association has experienced divorce first hand and now offers help and support to other men facing similar circumstances.
“I got involved in the Lone Father’s Associations in the 90s.
I had a wife and a house and kids and I grew up in the old fashioned way.
I came first and then my wife came along and the kids came along and I was responsible and I worked hard and I did that for 25 years.”
When George’s wife met someone else, she also took out a twelve - month domestic violence order against him, which stated, “she feared he may at some time become violent.”
“I was the second person in Australia to get one of these, they’d just introduced them.
I was kicked out of my house of 28 days and told never to go back there again,” he said.
“I started protesting because I felt the law was wrong.
You didn’t have to prove anything, you just had to say, ‘I fear.”
“I got involved because of the injustice of it, I had no say, and I virtually didn’t exist.
I didn’t like that you could be taken out of your house on a word and have no rights, no rights.” “I stood for three days in the rain protesting, in Canberra.
Barry Williams, Ex-President of the Lone Father’s Association came along and said, ‘why don’t you spend your energies helping us?’ and that’s how I got involved.”
Remarried and living in Cairns, George runs the Cairns branch and says there’s about 20 blokes involved at the moment. “People come and go as they get their problems solved.
We don’t have regular meetings, it’s more informal support.” George says there are many who need help and he’s glad he’s been able to make some difference.
“The thing I’ve been able to do is grow my life back again, but also help a lot of people. No matter how angry you are, there’s always light at the end of the tunnel.”
He said The Lone Father’s Association encourages parents to seek support and sustain their children within a happy positive family environment.

It's been over a month since my final hearing, so now may be a good time to do a short write up.BackgroundAs a background, I have one child, a 6.5 year old boy, and I had never married nor been domecile with the mother. However I spent substantial time with the mother at her residence, and I have been significantly and meaningfully involved in every aspect of my child's life in an unbroken manner since the beginning.After separation and upon initiation of proceedings, I sought 5 days out of 14 and continued with this stance through-out. The reason for this, as I explained to the Court, was the distance issue (I live 40 mins from child's school), and secondly, I was of the belief that the mother would not cope with 50:50, and I felt that this would ultimately harm the child.Contrasting ApproachesBefore I go on, I should mention the contrasting approaches to the proceedings between the mother and myself, which I believe had a very real impact on the final outcome.My efforts were very much non-personal and non-emotional, at least on the face of it, and I was in full recognition that the mother, despite her personal flaws, was a very devoted and loving mother. The mother for her part focussed exclusively on vilifying me. Her affidavit was hate-instilled, and her allegations were of the most sinister type.Interestingly, we both had support people/groups. I was lucky enough to have had the support of key people from this site, which I will elaborate on further down. The mother, as I had become aware, was supported by an anti-domestic violence group and a barrister who volunteered her services on a pro-bono basis, at the request of that group.Just by referring to an "anti-domestic violence group", I expect those who are reading this will feel, even in a sub-conscious way, that where there is smoke there must be fire. I know that this is what I would be thinking was I reading this for the first time. Surely if such a group got involved, something violent or at least somewhat threatening must have happened, right? WRONG!I don't know whether my situation is the norm or not, but we separated very amicably, there was never any violence nor any threat of violence, and there never will be. There were no police, no AVO's, no scratches, no questionable injuries, no threatening letters or emails or texts, NOTHING! And yet .......During proceedings, I remember thinking how much the mother had been betrayed by this group that purported to support her, yet was simply exploiting a vulnerable but complicit woman to promote their own self-fulfilling agenda. I still to this day believe that if the mother was properly encouraged to co-operate from the outset, we would not have ended up in Court, and the damaging events that occured in the midst of Court (including to our child) would not be part of our baggage today.But it is not only this anti-domestic violence group that had encouraged the mother into a ferver of anti-father/anti-shared care hysteria. I was in fact left mortified at the "buy-in" of so many family law support insitutions to this notion that I, as a separated father, must unquestionably be a vilain. This included an FRC- Family Advisor who convinced the mother not to negotiate any shared care with me (because its bad for kids), and amongst others, the independant children's lawyer, who stated that she would never agree to the child having any overnight time with me because "its just not healthy for a 6 y/o child to be away from his mother", and because "it would reduce the mother's child support." I would also add that the mother included anti-shared care articles from Adele Horin (Sydney Morning Herald) in her affidavit, which I am sure the mother saw as validation of her stance, and simply emboldened her to continue to resist any form of shared care arrangement with me.The HearingWell, my hope was not to go to final hearing, but whatever hapenned I thought it best that I get Consent Orders.Given the question-mark over the longevity of the current shared care laws, I knew that Orders by Consent were my best bet at maintaining an arrangement after any potential changes to the law. Although I am fully aware that 'significant change' would still be likely to be required to undo existing Orders, I was looking at the strongest outcome for the future under any circumstances, and that I thought would be it.Before we reached the point where our final hearing was imminent, I made an offer to the mother in the hope of avoiding Court, but this was not to be. No movement from her at all.So we went to Court. When I sat in the witness box at the beginning of the hearing, I remember saying the oath, and the Federal Magistrate looked at me squarely in my eyes in a fixed gaze. I felt strangely comfortable in this environment, and at the FM's gaze. I can't be certain why, but I knew that I had nothing to hide, I was making no bizarre allegations, I was not trying to shut anyone out of the child's life, I simply wanted my boy to have a real relationship with his daddy, as was the case before. I felt that this is what the new laws promoted, and this is really what helped me through this, a belief that the Court now, unlike the other support institutions, was guided by a good set of laws, not a gender based ideology.Anyway, the immediate direction the hearing took was a surprise to me, to the extent that it was so overwhelming. Not only was it quickly clear that I would get 5 days out of 14, but the Federal Magistrate agitated for me to accept 50:50. This was based on him seeing no credible reason why I should not, given the abundance of evidence of my very involved and close relationship with the child. I suspect my accomodating and supporting attitude towards the mother, as well as a distinct lack of any evidence of abuse whatsoever, also made an impact.The mother's barrister's line of questioining however, in line with the mother's affidavit, was ill-conceived, spiteful and quite surprising in its lack of legal emphasis. It reflected very poorly on both the barrister herself and the mother.After repeated warnings to the mother's barrister, the Federal Magistrate finally halted proceedings and said to the mother's barrister words to the effect, "I take it that your ongoing line of questioning is at the instigation of the mother. As such, as a matter of procedural fairness I am warning you that I will now be seriously considering the giving of primary care of the child to the father, despite it not being requested."The FM's very strongly worded comment about sole care was enough to finally encourage the mother to agree to Consent Orders.Looking backLooking back on this journey now, I can see that it was probably my restraint more than anything else that won me the confidence of the Federal Magistrate. I was accused of the most serious crime a father can be accused of, and at times I felt at risk of over-reacting, either by retorting with allegations too, or in somehow giving up or otherwise harming myself.But these laws, the laws so zeoulously condemned by many in the media, helped me focus on what I had in common with the mother of my child, not the differences. It helped me focus on our child, not our feelings. It helped me focus on being constructive, not of character assasination. It helped me put aside those allegations, serious as they were, and move on for the child's benefit.Were it not for the shared care laws, I have no doubt that despite my history of being meaningfully involved in every aspect of my child's life, that my little boy would today be deprived of having a father. These laws created an environment where co-operation was possible, I simply took advantage of it.I finish this of by saying that I have no ill-feelings towards the mother. In fact, a few nights ago we both spent more than 4 hours in the casualty section of hospital, waiting for our son to be seen for an ear-ache. We were both there, we both held our child as he fell asleep, and we both chatted together like old friends. This outcome is good for our son, it is good for me, and despite the remarkable resistance displayed by the mother, it is good for her too.On a final note and as possible assistance to others, I was an SRL up until the final weeks prior to my final hearing. At this point I entered into a minimal brief arrangement with a lawyer and barrister. This was because no barrister would agree to direct brief. This may be a very cost-effective model for other SRLs to follow, should the expertise of a barrister be needed come final hearing.In closing, I would like to thank a number of very special people from this site, who selflessly gave for the ultimate benefit of my child.Verdad, you always kept my focus on my child, not my feelings. Your mantra was clear, and you left a real impression on my proceedings. Thanks for your wisom and your help with the written word. Agog, you were there from the start. I have called you many times in a panic asking you questions on points of law. Thank you for your consistently steady hand in these matters. Mr Secretary, you will probably never get the recognition you really deserve, but I appreciate the efforts you made for me, all beyond the call of duty I may add. Monaro, your case alone has been powerful inspiration for me, especially after my Interim Hearing. Thanks for giving when I called for help. Singlemum an apparently new user on Familylawebguide joined and participated in the forums only to be blasted by the dumbest of the dumb, Mike Taylor, Peter Saxon akak Conan and the stalwart a**hole Michael Green aka Agog/Sisyphus.

MikeT was the first flunky sent in to attack her point of view which was against deadbeat dads and fathers and grandparents whose only involvement in a childs life was abusive. MikeT posted his usual cut and paste from the CSA website and spouted off his usual pompous gibberish. Trouble is Mike we've read your blog and Tricia's comments about your son so we don't understand your high horse attitude. Maybe a move back to England might be in order because we don't like whinging Poms here.

I am seeking to find out as much as I can about my German ancestors who came to Australia (state of South Australia - Barossa Valley) in the 1840s and then moved over to Melbourne in the state of Victoria, Australia.
Do you know anything of the origin of the name or its meaning?
It originally had an umlaut above the "a".
Do you know why they would have left Germany ('ost prussen'?) at that time?

"I don't see myself as a radical, I'm not the sort who wants to go ripping out letterboxes or shouting slogans," says this new recruit to the men's movement. "But the inequalities that were there for women 20, 30 years ago are now there for men. The pendulum has swung from too many opportunities for men to too many opportunities for women."

Black has entered the organised men's movement along a well-worn path: relationship breakdown. There are up to 200 men's groups in Australia, according to estimates - and many could be called estranged fathers' groups. They bear names from Dads in Distress to the cuddly sounding Fatherhood Foundation, and typically attract men in midlife. While the groups claim a growing membership, the extent of their support is unknown. The Lone Fathers Association says it helps 30,000 men a year, but their paid-up membership is 9000 nationally. However, La Trobe University researcher Michael Flood says the number actively agitating in the men's movement would be no more than 2000.

What makes them remarkable is that they subvert the traditional paradigm of social activism in that they represent the interests of the dominant group in society. Or do they? The argument these men's groups mount, with growing political muscle, is that they are getting an unfair deal, not only when it comes to family law issues but in other areas such as men's health. There is a growing lobby for free prostate screening, boys' education - crystallised in a federal push for more male primary teachers - and even domestic violence.

In Canberra, over two days of sometimes torrid testimonials, Black, 39, took heart from the shared experiences of men who, like him, had undergone unexpected separation from their spouses.

Two years ago, Black returned from work one evening to find his de facto partner had left home with their baby daughter.

"She was just six months old," he says forlornly. As he clutches a "showbag" stamped with the logo of the Child Support Agency (it contained pen, pad and instructive government literature), he reveals the source of his feeling of powerlessness: "I've only seen my daughter five times since then."

Back in session, Barry Williams, the president and founder of the Lone Fathers Association, prosecutes some of the familiar themes of the men's rights movement in a mild tone sometimes at odds with the strength of his rhetoric. "Both men and women are, in fact, equally likely to be perpetrators of violence in relationships, although women are somewhat more likely to be seriously injured," he declares.

He warns his membership to be on guard against "further development of an ideologically based domestic-violence industry funded by the taxpayer". "There is a very serious issue of discrimination here," he says.

It's these sorts of arguments that bother researcher Michael Flood about the growing influence of groups such as the Lone Fathers, a peak body formed 32 years ago around the time the Family Law Act was established. The group is now federally funded.

This week's conference attracted two federal cabinet ministers - Family Services Minister Kay Patterson and Attorney-General Philip Ruddock - to Wednesday's opening. Sex Discrimination Commissioner Pru Goward spoke the next day.

Flood does not dismiss serious issues men contend with: old certainties have been swept away as women's roles have changed. He has researched the intensity of the loneliness felt by many men.

The loneliest men of all, a survey published this year concludes, are sole fathers rearing children. More generally, when males hit midlife they feel most isolated, especially if they live alone.

Yet Flood believes a more nuanced approach is needed than simply railing against domestic-violence programs.

"We need to address men's pain in these areas, but without blaming women or putting children at risk," he says. "Yes, men can now cry on TV, but the institutionalised power relations between and among men and women have hardly gone away."

Eva Cox, who was at the barricades as a founding member of the Women's Electoral Lobby, believes men's rights groups are making the mistake of using some of the oppositional "victim strategies" that women once deployed but which, in retrospect, did not necessarily serve them well.

"They are blaming a lot of what's going wrong on women for taking things away," she says. "But we are not running the world, sorry. Where are the female law partners? Where are the female senior surgeons? . . . If you are looking for men in primary schools, tip them all out of the principals' offices."

While citing the continuing disparity between men and women's pay - for every dollar men earn in full-time work, full-time women earn 85 cents - Cox is not unsympathetic to the plight of low-skilled men, many of whom have lost the opportunity to do their fathers' and grandfathers' jobs.

Economist Bob Gregory has tracked the impact of the decline in manufacturing on men's income. In 1982, about 500,000 men of working age were on welfare. Now, there are about a million men on benefits and the job boom over a period of apparently unprecedented prosperity has barely reached them.

Monash University demographer Bob Birrell, who conducted a study of the clients of the Child Support Agency - which has 90 per cent of Australia's separated parents on its register - concludes that most separated fathers come from the ranks of the poor and low-paid. "Marriage is closely associated with the resources men can bring into a relationship," he says.

In a separate study on partnering, Birrell found the greatest decline in partnering rates in Australia was among low-income men.

Paul Black, who made the lonely journey back from Canberra yesterday, counts himself luckier than some of his contemporaries. He has a stable trade as a plumber, but the loss of his daughter and relationship has left him deeply confused.

"Towards the end, we were fighting about the housework," he says. "But I thought there were two roles there: she didn't work, so she was the homemaker and mother. I was supposed to be the provider and father."

We know that there are less than 2,000 men who are responsible for the Fathers Rights movement in Australia because we have their names. In may case I wasn't even accused of sexual abuse, the allegation was that there might have been sexual abuse, based on me teaching my daughter how to XXXXXXXXXXXXXX and that my daughter had seen me XXXXX. I understand that the only way these dirty tactics get overturned is when a court is persuaded that there is deliberate alienation going on. However be careful never to mention the syndrome ie: PAS or you'll get nowhere. The fact that you haven't been interviewed might assist you in your case. I wish I had done this. The idea that all will be well once they find the allegations aren't substantiated is fanciful. "When your going through hell keep going" is about the only other advice I can offer. Perhaps you should start researching how the alienation defense has been used successfully in other cases. And remember litigation is about devastating the opponent. Don't let the fact that she the mother of your child allow you to be soft. Her lawyer certainly won't be going soft on you, and she probably would have lost control of the process long ago (or be in such a state that she is vulnerable easily manipulated). Unfortunately these stories don't have a happy endings. The best you can hope for is persuading the court that your ex is 'the abuser' to maximise your contact. We ask when did Michale Green become such an expert on violent behaviours after separation. Was it due to his own experience as we are in receipt of information that says Michael Green has no formal qualification whatsoever in psychology, sociology of psychiatry. What makes him an EXPERT? Is it in his practise of mediation where he fails to declare hs obvious bias towards fathers and men? We are very happy to see the recent changes to accreditation and intend to raise this issue with the AG's office.

I will volanterr a peace and good behavior when I go to court over the DVO, but as I strongly believe that communication is essintal to good paranting the rest of the order I shall contest. I have also tried on many occasions to attempt to re-concil with my partner, but have been in vain. I wont say our relationship was a bed of roses latly, as we had been under alot of stress from buisness and her mothers constant interferring in our relationship, and the fact that I had given up smokeing late last year, but as I had never stuck her, only had verbal disagrements, with me haveing the loudest voice. She has claimed physical abuse such as I struck her twice in the upper right thigh with my fist(as the most recant) I never did this but am afraid as she has a iron defenancy wich leads her to bruise very easily. There are also claims that I threatent to kill her in front of our children, I know it dosnt sound good, but I never did such a thing, I love her very much as I do with the kids. I have come to grips that she dosnt want anything to do with me anymore(breaks my heart) but I have to deal with it. I will do whatever I have to to be close to my children as I always have, but am afraid that she will block me at every possible opppertunity. I am going to the mediation today so I will post the results this afternoon, but I am not hopeful of a good outcome, but hope and pray otherwise(I am a active member of a church) This is very distressing especaly in the fact that I havent seen my children since the morning of the 21/5/2009... my defaco left afer a bad verbal fight, when i was out working, she took the kids and my car, i never hit her or implied the such, but did threaten her parants as they had often threatened me. she had applied for a dvo and it is going to mention, is there a fair chance that i could contest it, as my beliefe is that a woman dosnt have to prove anything, just allage that she was threatened. how do i defend myself against this dvo????

BUSINESSMEN who have tried to reopen their divorce settlements to seek a larger slice of the pie because their post-divorce wealth has fallen dramatically in the global recession have had no luck in the courts.

Now the shoe is on the other foot and a legal precedent has been set blocking women from claiming a larger portion of their former husband's bigger asset pool.

In a British case this week Kim Walkden failed to claim a larger share of the assets of her former husband, Martin, whose wealth had quadrupled since their divorce.

Because Mr Walkden took his slice of their assets in shares in his timber company, and his wife took cash, he ended up better off. A year after the divorce Mr Walkden cashed in his shares and pocketed about 3 million.

He ended up with 82 per cent of the assets and Mrs Walkden 18 per cent. Mrs Walkden received 225,000 in cash, about a quarter of the estimated value of the company.

Sue Pearson, of Pearson Family Lawyers, a Sydney firm, said Australian courts were also unlikely to allow divorced spouses to reopen an asset settlement.

She said the Walkden decision was in line with the case of a British-based South African financier, Brian Myerson, who has failed to compel his former wife to return the 11 million she received in their split."

And your traffic figure is another thing you lie about...we have seen Wayne and Michael Green brag about figures of 1,000,000 hits a month when the actual figure (easily accessed via the net and various sources) are only 1,500 hits per day which is not even 100,000 per month. We figure you have to justify the spending of Australian Government money somehow and none of you can tell the truth. Which brings us to another issue, we believe that the funding you did obtain was gained through dishonesty and we intend to follow this through. We believe you should be made to pay back the funds you have misapropriated from the Australian people and it is our mission to ensure that you do.
As snarly as you have lost ground now that they are winding back the changes to Family Law, you sure will be a lot grumpier then.

SPCA Views on Homosexuality

Interesting article on what the Shared Parenting Council think about Homosexuality. It's the Festival of Light magazine and details how the FOL are a part of the Shared Parenting Council of Australia.

Shared Parenting Council of Australia Closing Down!!

Wayne Butler from the Shared Parenting Council of Australia has announced that because they have been unable to obtain funding that they will be closing down. Unsuccessful attempts to secure government funding has meant that they are unable to proceed with planned Contact Centres.

The woman and children of Australia can all breathe a sigh of relief although they should remain on alert because like cockroaches, these vermin will not be eradicated.

Child protection experts say it's time Australia's child custody laws put children's rights before those of squabbling parents.

The Federal Government is reviewing the controversial Howard-era shared parenting laws which forces courts to consider joint custody, and frantic lobbying by interest groups has already begun.

Chairman of the Government's peak family law advisory body, the Family Law Council, Professor John Wade, said shared-parenting rules risked creating a generation of ''ping-pong children'' being shuttled between warring parents and needed to be changed.

The laws are subject to an automatic review carried out by the Institute of Family Studies this year, and battle lines are being drawn between the increasingly influential parents' lobby groups.

Some parents groups have welcomed the news of the possible changes, but fathers' rights campaigners, who lobbied for shared parenting for more than 25 years, have vowed to fight for the retention of the laws.

Under the current laws, the court's default position in relation to custody is an equal and shared parenting arrangement if it is deemed in the best interest of the child.

Child defence expert witness Charles Pragnell says children are often being placed in dangerous situations by courts forced to consider shared parenting, and gave the recent example of a Melbourne court ordering that an 18-month-old spend alternating weeks with each parent.

''That will have a tremendously traumatic effect on that child, and cause severe and long-lasting emotional harm,'' he said.

''Children of that age and older need a sense of belonging, consistency and security.''

He referred to several high-profile cases where courts had placed children in danger with tragic consequences, such as four-year-old Darcy Freeman, who died after her father threw her off Melbourne's West Gate Bridge in January.

''The law is concerned about parents' rights, and gives very little account or regard for children's rights, even those children's rights under the UN Convention to which Australia was a signatory in 1991, but hasn't done very much about,'' Mr Pragnell said.

''Children's rights in this country are appalling compared to the UK and European countries.''

A spokeswoman for the National Council of Shared Parenting agreed that the current family laws gave priority to the parents, rather than their children.

She said when one or the other parent was forced into a custody arrangement, this often created unsafe or unhappy environments for their children. ''How do children get protected in all this? Their rights are being forgotten and not heard,'' she said.

''It's an awful situation, and it's made awful by the fact that it's so preventable.''

But Lone Fathers' Association President Barry Williams vowed that the fathers' movement would lobby hard to retain shared parenting.

''We've called for an appointment with [Attorney-General] Robert McClelland, and I'll be taking quite a few people from quite a few different organisations,'' Mr Williams said.

''We're going to try to convince him not to take any notice of this rot that's being put out by people with vested interests.

''In cases that we deal with, the children are quite happy and they like the shared parenting arrangements.

''We had 30 years of the old system when hundreds of thousands of children never saw their fathers.''

But one Canberra family lawyer, who did not want to be named, said one of the most frustrating aspects of the law was seeing a parent, usually a father, who had previously had little role in caring for his children and had showed no interest in their wellbeing, suddenly demanding shared custody.

Why are so many mens and fathers rights groups part of the CSA Stakeholders group?

Why the inequity of having 75% of the stakeholders groups represented by militant mens rights groups who promote violence against women?
The only group purporting to be representing women (and single mothers at that) is headed by Ms Swinbourne and could hardly be attributed the same amount of resources and funding as the other groups put together. The Lone Fathers Association is The Shared Parenting Council of Australia anyway and Dads In Distress is a close ally and they all work together.
Why is the Stakeholders group so unfairly stacked against Payees who are the beneficiaries? The mens rights groups have a vested interest in providing advice that seeks to avoid or minimise Child Support for the good of children, why is this situation allowed to exist???

Wayne Butler and his cronies at Shared Parenting Council missed out on the government funding their woman and child hating forum and Barry Williams despite his frantic sucking up (sorry lobbying) in Canberra failed to secure more retirement funds to finance his cushy jetsetting lifestyle must be stewing in their own juices when the Department of Human Services announced that they would instead be sending the funds to the Child Support Agency.

The $223.2 million in funding is specifically to maintain services and address the mounting Child Support debt. As Child Support is exactly that and intended for the support of children, there are an awful lot of Australia fathers who don't give a toss about their children.

A recent media release also detailed the amount of greedy men seeking to take advantage of the governments generous stimulus payment and lodged their tax returns only to end up getting caught by the Child Support Agency for non payment of Child Support.

It must really grate! Good!

Lifestyle Guide for the Divorced and Unemployed.

FOREWORD

I was once a normal person. I had a loving family, a beautiful wife and two young boys. After several years in the workforce as a wage earner, mainly in the Commonwealth Public Service, I decided to spread my wings and take on private enterprise. My intent was to be able to provide the best for my family. I was very successful, I was even awarded two Australian Productivity Council Awards in the same year for best small business and best quality product; in the latter award I beat such large enterprises as the Hobart City Council, Cadbury's the chocolate factory and even Pasminco Hobart Smelter. I was a souvlaki maker, owning one of the Parthenon Souvlaki Bars, number four, in Salamanca Place, of Hobart and also the most successful shop of all in the chain. I engaged in an aggressive promotion of my business and products thus proving, to present and future clientele, that souvlakis, cooked properly under the guidance of the National Heart Foundation, are a healthy alternative to regular junk food. I was motivated to this course as I had suffered high blood pressure and cholesterol levels. It dawned on me that I ate most of my meals at the shop. Hence if I was to regain my health I would need to change cooking processes at work. I ran a business with eight full timers and about a dozen casuals. I owned a near waterfront property in the upmarket suburb of Tranmere. I even put in a proposal to the city council that resulted in the widening of the footpath along Salamanca place, combating conservative factions of the council and changing the look of Salamanca forever. Up until then my business was the only one with tables and chairs out the front. Salamanca place, with its widened footpath, is now renown world wide for its cosmopolitan atmosphere and its ample al fresco eateries. I was successful, overworked and overpaid. It all came crashing down when I realised that my marriage was to come to an end.

I won't go into any of the specifics of my divorce. I have moved on and besides, this is a book about surviving divorce. I don't even wish to give the impression that it was my ex wife's fault. It always takes two to mess things up. I was a slob and never spent a lot of time at home. I did pay for a gardener, a maid and the occasional dog's body to chop and stack wood; however that was no substitute for being there. I would wake up at 6am and come home at 10pm at the earliest. During the last year of my marriage I lived a zombie like lifestyle. I would get home, maybe have a quick bite to eat and then lay in bed, quite often fully clothed. I would not dream. I would close my eyes and after a split second open them, only to discover that it was morning and the ritual was to start all over again; a Ground Hog's Day nightmare. I didn't see my kids very often due to my extended working hours. I had become my father. I resorted to buying one of the early model mobile phones and installing it in my four wheel drive, so that I could chat to my boys whilst in between shopping for supplies. My wife did warn me not to buy another seven day a week business, and I tried. I looked for six months and the only profitable ones I could find were the seven dayers. The problem was that the state government had given out a heap of redundancies. This resulted in a surplus of businessman wannabes that had more money than sense. Every time I tried o negotiate a fair price for the purchase of a business, a wealthy redundant ex state public servant would crop up and pay top dollar. In about a year, there was a glut of businesses for sale at bargain basement prices...on the market because the same ex public servants discovered that there is a lot of work involved in running a business. I honestly did try.

Suffice to say I was lost. I wasn't just broke, I was in debt to the tune of about $16,000 with a strong desire not to go bankrupt, but no idea how to repay my debts. If I owed half a million thereabouts, it would be logical to declare bankruptcy. But the amount that I owed was too little for bankruptcy and too much to be able to repay, whilst out of work. I also had no idea where to go from here. I can remember the very first time I had access to my children and the very first time I had to drop them off and leave alone. I cried a lot. I often tell anyone that is kind enough to listen that the day my marriage ended was the worst day of my life. On that day, I discovered that I had lost my wife to my best friend (editor's note. I recently found out that it was to my two best friends!!). I also discovered that the baby girl in my wife's womb was not mine. Unfortunately little Zoe did not make it, she died after being four and a half months in her mother's belly. Ironically, Zoe means life, in the Greek language. My two German Shepherds were also put down that day. It was as low as I could get. But I survived. I became stronger for it. There is only one thing that could devastate me now and that would be the loss of a child. The good news is that any other disasters life will throw at me are minor in comparison. This is why I smile a lot. Nothing bugs me, no one truly upsets me (except when trying to hit me in a night club) and up until recently, I've chosen to live one day at a time. My volatile ex girlfriend Julie (we were actually engaged three times in five years) gave me reason to move on, reason to want to grow, reason to set not only financial goals but moral and spiritual ones as well. I'm still exploring the latter having been an atheist all my life. I'm not into church worship; traditional Greek Orthodox exposure has put me off for life. Instead I try and live my life honestly, believing in the concept of Good Karma. Do the right thing and life will eventually give you what you want. It's a strange concept to grasp when the reality hits you that you don't really know what you really want. I used to think that it was riches; I now realise it is something as simple as stability. To be happy with what you have and who you are is the beginning of accepting yourself. It's been said in many self help books that first you must learn to love yourself before you can truly love another. You must also learn to live your life for yourself and not through or for some one else.

Let there be no doubt that this is a highly soul bearing book. Some of you may even feel embarrassed whilst reading some sections. Some of you may not get past the regular bragging and sexual adventures. The point that I try to make is that this is how I survived by reacting in that particular fashion. All caution went to the wind. The other point to bear in mind is that if now, down the track, I attempted to re-write many of the passages; I would be lessening the quality of the whole…and why? For the sake of making me feel safer via the lessening of the embarrassment factor of the segments? Its best to leave my work alone as it truly reflects how my mind operated at the time. Keeping things unfiltered, unchanged may result in some crassness; but at least it is valid crass…well here it goes:

In September of 1991 I was miserable, lonely and lost. I thought that my world had come to an end. What I would like this book to be is, for starters an easy read, which any one can come to realise that life is what you make of it. You start with nothing, its all downhill hill from there. If only I could have grasped that single concept at the time, I may not have worried so much. I made a commitment to myself that I would write all my thoughts, as silly as they might seem in hindsight, with only corrections to grammar and spelling. I have written sober, intoxicated and stoned. I have written when happy, when angry and when sad. I have employed a disorganised approach, as that is also the way my mind was working at the time. You will experience flash backs and my never ending fetish for side tracking and shooting off in tangents. I talk about how to succeed in business and university. I even mention several great feeds, to the point that I have included a recipe section at the back. I did work as a chef in many restaurants over the years.

The actual inspiration to start writing about my experiences came in 1997 when my father died. A realisation emerged that my wonderful father who had provided all for me over the years actually didn't. Dad gave me material items, anything I wanted, all I had to do was ask, or whinge. What Dad didn't do was talk to me, give me a chance to get to know him, find out what his thoughts were on any issues. I realised that I didn't know that much about him. He was too busy providing for his family, too busy working seven days a week. I guess I turned out much the same, only I didn't have as tolerant a wife as he did. I didn't want that to happen to my kids; not really knowing what their father was like, so I started writing. I was devastated at the loss of my father. It was not a good year. A few months earlier I had also lost my close friend Derek Chan. A wonderful, brimming with promise young man of 19, Chinese by descent, and my top choice as my assistant head of security at the night club that I worked. Derek died in a freak car accident, when his new sports car rolled out of control (possibly was left in neutral with the hand brake not quite on) out of his garage, down his steep drive way and ran him over. I miss them both.

I never intended to write a book, it started as just a few notes on a cheap laptop, sort of a diary. I was so down, that I ended up resigning from all my casual jobs. All I did for several months was write. It felt good to get my thoughts on paper, and like I said, the intent was so that there would be a permanent record for my children to read later on in life, in case I made the same mistake as my father. I was oblivious to all around me during this phase of my life. If I forgot to pay the hydro bill, I simply used kerosene powered lights and cooked in my four foot long open fire place. At night, which is when I did my best work, I would borrow power via a very long extension cord, from the communal power in the laundry room, from the block of flats that I lived in. At six am and before my landlady would arrive for her daily reconnaissance inspections, I would retrieve the extension cord and catch some sleep, only to repeat the ritual in the afternoon, when I knew that the coast was clear.

It does amaze me that when I decided that I would actually keep writing with the expressed intent of putting together a self help book on surviving divorce; that I would end up working for a government agency dealing with post divorce/separation support. I am a technical advisor with this agency. Its straight forward, plenty of client contact and minimal exposure to office politics. If the topic hadn't been a boring one, I may have written about office scurrying. I guess that at the end of the day, human interactions will always involve some level of manoeuvrings. It's very entertaining to watch less popular staff align against popular staff and try and score points against each other. Once you become aware that this is happening, you can do away with reality TV shows and entertain yourself at work. It will certainly make the day go faster. Lets face it, if you have to work for a living, not having had the benefit of a very fat inheritance etc., then it is imperative that you either love what you do for a living or…chose a job where time flies. I don't think that many would believe my following comment…I love my job and time also flies. I just wish that it paid better. Having spoken to several colleagues that do the same work in other countries, we seem to get paid more for what we do.

I tell you now, I am no expert in anything that I talk about, and life has been my apprenticeship. Learn from my mistakes as I eventually did. I just seemed to have amassed a very wide range of experiences in life and have some how managed to survive it all. If I can survive, anyone can. The difference to you is that you have the precious opportunity of learning how another survivor did it. Remember, divorce or separation is not an end; it is the beginning of a new era, a rebirth, and a unique chance to start all over again and hopefully not make the same mistakes. Your forward growth will actually commence the moment that you stop looking at that rear vision mirror. Its that simple.

Supporting services - the story of MAACS, and activities by Government Departments

The Mens’ Accommodation and Crisis Service (MAACS), run by the LFA ACT, was
established by Minister Stefaniak in the ACT in March 1999.
MAACS was designed to provide emergency accommodation and support to fathers, and in many cases also their children, left homeless as a result of domestic discord. (But you got Stefaniak to tell the Government enquiry that you had helped 60 men and 100 children?)
MAACS was the first service of its kind in Australia. (Yeah if ripping off the Australian taxpayer on the fruadulent misrepresentation of Domestic Violence is a first then you can have the accolade.) The LFA had been lobbying for this service for 20 years. It was established against strong opposition from the ACT Domestic Violence Crisis Service (DVCS), which has an avowedly “feminist” charter. (You mean it's "feminist" because it helps women and you say that like it's a bad thing to help women and yet here you are saying you're setting up the same service for men and yet if you do it, it should be considered something to brag about?) MAACS received ongoing funding of $100,000 per annum (yes and the rest) , compared with an average of$400,000 per annum per refuge for women’s refuges. (you know yourself that that figure isn't true and that all the refuges received the same $100,000 but that doesn't sound as good when you're whining does it?)
The LFA, during its three-year tenure in running MAACS, filled an increasing part of
the yawning gap in current practice in the ACT in relation to:
- genuine holistic case management and coordination with other relevant
services for men and their children. This included, importantly, assistance in
obtaining legal advice and legal aid; (where was it stated that you were required to provide legal advice, your funding was for accommadation for homeless men and children)
- information services for men about relevant issues and services; (where was it stated that you were required to provide information services, your funding was for accommadation for homeless men and children and information on what?)
- advice to supplement and temper that coming from sources such as the now
officially established Office of Women, and from some groups associated with
Partnerships Against Violence, and (where was it stated that you were to provide advice, your funding was for accommadation for homeless men and children)
- peak body consultation with the community about relevant issues. (where was it stated that you were required to provide peak body consulation and to whom?)

In late 2001, the former ACT Department of Education and Community Services
(DECS) decided, following continuing lobbying by certain opposition groups, to put
MAACS out to tender. (as is required by law and also to provide a fair and TRANSPARENT method of funding. And it was put out to tender because when they evaluated the "service" you were providing they found huge problems and terminated your funding.))
For the proper administration ofthe contract with the service provider, it was, in the
LFA’s view, incumbent on the funding authority to act in accordance with the
considerations that: (The government decided to do the right thing and look into your crony relationship with Stefaniak and as a result you lost your position, you don't have any rights then).
- the contract between the service provider and the funding authority
specifically provided that any declared dispute between the parties should be
subject to a mediation process; and (when you lied to the Evaluation tema you lost all rights.)
- there was a requirement to comply with relevant policy guidelines in
formulating the decision to put the service out to tender, a requirement to
carefully consider the criticisms made by the LFA of what was, in this
particular case, considered by the LFAA to be an extremely. faulty
“evaluation”, and a requirement, under Government guidelines, in assessing
tenders to check referee reports back with the referees themselves. (Bottom line is you lied and got caught out.)
It was also, in the LFA’s view, necessary for the proper administration ofthe contract
that the funding authority avoid:
- recording, maintaining, and/or utiising incorrect and prejudicial information
about MAACS’ operations which MAACS had no effective chance to correct
or rebut;
- asserting a requirement under law to do things that were not in fact legally
required ( e.g., to put the MAACS service out to tender), and/or impeding the
LFA’s legitimate political role, by the letting of the tender at a time which
would preclude action by the LFA (e.g., the day before the ACT election); being unduly influenced, in drawing up tender Terms of Reference for the
tender and in making assessments, by the opinions of any other agencies
which may have been opposed to the establishment of MAACS in the first
place, and/or by arranging, for example, for Departmental officers in receipt of
incorrect and prejudicial information, to sit on the tender evaluation panel.
Unfortunately, the above stipulations were, in the LFA’s view, not met.
As to the reasons for why they were not, it not our place to speculate. However, in
the LFA’s opinion, the tender process for MAACS’ successor service was
fundamentally flawed.
The LFA was primarily responsible for the policy initiative leading to the
establishment of MAACS. (Get over yourself. You had an idea to rip off the government, stop patting yourself on the back.) Its successor service played no role in those
developments, apart from some of their leading members actively seeking to block
them. (yeah but at least they were honest.) To replace the initiator ofthe project with the opponent of the project, and a
different ethos, should have required very strong supporting reasons - which were not
available. (you lied and you created a shoddy service that self supportd your own outdated ideals...get over it.)
This, in our opinion, tended to undermine public confidence in the allocation and
distribution of public funds in the welfare and support sector in the ACT, and
damaged the overall ability of the community sector in the ACT to provide this
necessary, unique, and very valuable service to a seriously disadvantaged section of
the community. (No it's people like you who spend a whole lifetime sponging off the tax payers in this country that undermine public confidence.)
MAACS was able, in a high proportion ofcases, to help families not only to deal with
their family crises but also to reconcile in a way that was safe for all the family

MAACS’s clients were overwhelmingly positive about the service they
received while at MAACS (see attachment). (Do you mean Emily the 10 year old that supposedly wrote the same letter as other people in exactly the same words that you tendered as evidence of your success?)
The LFA believes that, in the interests of fathers and their children in potential marriage breakdown situations, services of this kind should being strongly encouraged, not only in the ACT but in other locations around Australia, but should not be run by self-proclaimed “feminists” or their close associates. The failure to establish such services would be yet another example of failure to deal
with the many cases where separated families could, with better policies and
administration, have been reconciled, in the interests of both the children and the

It seems Barry Williams has been conning the Federal Government and the Australian Tax Payer for years. Apart from obtaining Government funding for so called mens health issues and trading on the back of the suicides of men in our society and using statements like these in 2003 to obtain that funding:

We challenge you Barry Williams to name names. We're sure some families of those that have suicided as a result of the CSA hounding would love to have their voices heard and have the CSA held responsible. Or is it that you lied???

Then Barry Williams saw a new avenue to fund his lifestyle down in Canberra, Get the government to pay for a Mens Crisis and Accommodation Service (MAACS) which surprise surprise did not allow women. What's that? Discrimination? Isn't that what you bleat about now about Womens Refuges? The service was for men AND THEIR CHILDREN to be all placed in one cess pit of violence and anger. If in fact you did get any clients and again we challenge you to name names of people who actually used this service, you thought it was ok to place children in an environment full of suicidal and quite likely violent men that most likely had allegations of child sexual abuse levied against them because as you say yourself, all women do this to gain an advantage in the property settlement? What the hell were you thinking? Thank goodness someone saw some some sense and got rid of you.

5. The Lone Fathers' Association's fixed lease agreement with ACT Housing expired in March 2000. From that time the Lone Fathers' Association was on a standard two week Community Organisation Rental Housing Assistance Program tenancy agreement. The Lone Fathers' Association was served with an eviction notice on 21 January 2002, when the organisation made it clear that they would not vacate the premises when their purchase agreement with the Department of Education and Community Services expired on 31 January 2002.

6. The Department of Education and Community Service's purchase agreement with the Lone Fathers' Association allocated $105,859 per annum (excluding GST). An additional $10,000 per annum was recently allocated to MAACS under the Community Capacity Building initiative.

In addition, the department allocated an additional $5,000 per annum to the Lone Fathers' Association to purchase professional supervision services to improve the performance of their workers.

The service tendered for was an extension on that previously purchased by the department. An additional $50,000 was made available from the Supported Accommodation Assistance Program (SAAP) for the purchase of outreach support to families who have either recently left a refuge or who are at imminent risk of becoming homeless.

MR WOOD: Mr Speaker, I am aware of half of that story, that is the half in which there is $4,500 owing in redundancy payments. I am not aware that the $20,000 has been frozen. However, the advice that I have is that such commitment as there is is a responsibility of an organisation. There was a claim earlier that it should be paid by somebody else, by the government or something. The suggestion in reply is, as I recall, that the money owing to the person should be paid out of the remaining funds. If they are frozen, I can see there might be a problem, so I will check the second half of the story and see where we may take it.

MR STEFANIAK: Minister, I do thank you for that, at least, and I will liaise further with you. Will you endeavour to do that as a matter of urgency, as I understand Mr Carter has been seeking what is rightly his for some time now?"

Here is where Stefaniak tells the Government that despite "homeless men with children" being very rare, Barry Williams is receiving calls "at all hours of the day and night from men with children" in order to defend his friends deception to the government. MR STEFANIAK (11.09): This matter has been hanging around for a while. I must admit I was a little bit concerned about the government response. Homelessness is a very serious issue. In the latest Chronicle we saw a very sad story about homelessness. Homelessness among men particularly is a distinct problem. The Chronicle referred to some figures that have been with us for almost 12 months. Up to 2,000 single men have been unable to find crisis accommodation. The St Vincent de Paul Society indicated to me and to the committee that they turn away up to six homeless men a night.

It is not common to see homeless men with children. Nevertheless, that is a very real problem. The committee looked at accommodation and the support services for homeless men and their children. The inquiry arose out of a motion I moved in December 2001 in relation to some problems with the contract that was awarded to group to run a shelter in Belconnen for a homeless men and children. That contract cut short the tenure of the group running the shelter at the time, Lone Fathers. There were a number of problems with the way the department looked at that service. There were significant concerns with the report by the so-called independent consultants. There were factual errors, from what I could gather, and there were some real concerns with the way the department accepted that report. There were all sorts of allegations of bias in the way the consultation was done. I thought that with the significant problems the minister should have put everything on hold and have the new minister investigate it. He did not-I think that is an absolute shame-and another group took over.

I said at the time that I was not going to bag the other group. They went in there with every good intention. They were the successful tenderers. Their philosophy was somewhat different from that of the previous runners of the service. The question here is the need and the government addressing the need.

We saw a clear need for not only one service on the north side but also a service on the south side. For months after that, as housing spokesman I kept getting figures from Barry Williams, the founder of the service for children and men in Australia. He was getting phone calls at all hours of the day and night about men with children in crisis. Quite clearly, there is still an unmet need. There is a real need for a similar service on the south side. I am disappointed that the committee report does not go far enough. I think it has a bit of window dressing. It could have made more useful recommendations to the government about this service.

When we think of homelessness, we think of homeless single men and we often think of women with children in crisis needing special accommodation. Compared with other places, Canberra is quite well served with accommodation for women with children. The crisis services do a very good job.

More and more we are seeing men with children being left out on the street. Under family law, once the mother always got custody of the child. I am advised that in about 40 per cent of cases now the father gets custody. That is just one of the changes in our society. Even though a lot of people might not think of men with children being out on the street, their need for crisis accommodation is real.

The service that Barry Williams set up was an Australian first. ....It was a good service that looked after about 60 men and 100 children during its operation. (Name, names Barry) I was very disappointed-indeed, quite angry and even disgusted-that Lone Fathers lost that service and that the government did not look at the matter properly....

I read her comment about the "$30K cost each" as being what it would cost if they DON'T settle at mediation. Which I believe is probably fairly on the money. I've heard of family lawyers saying to their clients that it will cost them the price of a car each to go to court.

It's funny that he wants to talk about stalking and harassment when we have the log files of just how many times he has come to this blog, along with his wife Annette and neighbour and crony Ross Mitchell (along with his brother Keith Mitchell). We also have copies saved of all threats made on Dads On The Air forum and emailed personally to us.

Obama pays Tribute to Some Fathers

Monaro, Barack Obama wasn't referring to you and your cronies in the fathers rights industry when he was paying tribute to fathers. He specifically referred to "loving and caring fathers who are strengthening their families and country."
There is nothing loving or caring about avoiding or minimising the payment of child support, there is nothing loving or caring about discussing your children and your children's mothers on public forums and denigrating those people, there is nothing loving nor caring about advising other fathers on how to avoid paying child support, there is nothing loving nor caring about calling all accusations of child sexual abuse by fathers false. If you genuinely cared about your children more than yourself, you would join the fight to ensure they had a loving relationship with both parents and and you would ensure that your children were adeqautely cared for both physically and mentally. You are not seeking to strengthen any family, only tear it down in the interest of self.

The journey of fatherhood provides unique and lasting joys. Cradling a baby in his arms, a father experiences the miracle of life and an unbreakable bond. Fathers imagine a world of possibilities awaiting their children and contemplate the privilege of helping them reach that expanse of opportunity.

As kids grow and mature, they look to their dad for a special kind of love and support. Providing these necessities can bring great happiness.

Communities must do more to counsel fathers. Family and friends, and faith-based and community organizations, can speak directly with men about the sacrifices and rewards of having a child. These groups can support men as they take on the great challenges of child-rearing.

Through honest and open dialogue, more men can choose to become model parents and know the wonders of fatherhood.

On Father's Day, we pay tribute to the loving and caring fathers who are strengthening their families and country.

We also honor those surrogate fathers who raise, mentor, or care for someone else's child. Thousands of young children benefit from the influence of great men, and we salute their willingness to give and continue giving.

We also express special gratitude to fathers who serve in the United States Armed Forces for the sacrifices they and their families make every day.

All of these individuals are making great contributions, and children across the country are better off for their care.

All this back and forth discussion is clouding some of the facts and more information.

Firstly Michael Green and the SPCA have been outspoken critics of Section 121. The FLRA website evens contains an article of why they think ‘it’ should be rewritten.

Coral Slattery heads up the FLRA which is an independent organisation and a member of the SPCA. Apart from providing many submissions to the HORSIP inquiry they do a lot of work on schools policies. There is a recent article about their attempts to get the Attorney General to implement a Nationwide schools information policy for the ‘other parent’.

Family Courts in Australia are not secret Courts and this be may be why Michael Green did not respond in the way you though he should have. The Courts are open and Judgments are published. It is the anonymity of these publications that causes these organisations to rail against Section 121. That said ‘any’ judgment can be ‘anonymised’ and published.

Both these organisation house their web sites on the familylawwebguide portal and both have forums on that site. I am aware that very much tougher rules apply to posts made on flwg because unlike this closed email site, it is a public site and has some tough posting and moderator rules. The site also has ‘go forward’ groups on it that do not appear to tolerate whingers and what they constantly refer to as ‘hot air merchants’. Their agendas are clearly legislative reforms and legislative fine tuning. I suppose with the incredible success of flwg they want to keep it focused.

There are several articles on flwg about a recent meeting with the AG. At this meeting were Coral Slattery, Wayne Butler (Secretary SPCA) and Michael Green. One of the Agenda items was the mis use of AVOs to prevent contact. Other items included the SPCAs long standing opposition to the mis use of Rice and Asplund. This is all public material and freely available on the flwg site.

Have things changed? Well over the past week I have spoken to three Fathers that were in Goulburn Street. Within the same period of a week all three had orders that three years ago no one would have dreamed possible. Two of these were srl’s and part of the SRL Resources mob on the flwg. I am also a member of that group and I understand that is not a member of the SPCA although several of its senior people have been offered SPCA postions. If anything this is one group that because of their constant frontline experience can tell whether there have been changes in the way the Courts work.

I don't believe so... The mediations are generally between the two parties (All the cases I have dealt with have been) and some centres have child inclusive mediation if the children are older. One of the issues with mediation is that there is a fairly extensive "Cooling Off" period similar to buying a car. If you change your mind you can basically walk away. In any mediations I have done I generally get an agreement prepared during the various sessions that both parties have agreed to and then have both sign off the document BEFORE they depart. Various mediation operators have different systems. Some give the base white board list of issues to take away and think over and come back to discuss areas that can't be agreed. Also take a look under the guide area on the site at Parenting Plans and Orders by Consent and look at the differences. A decent parenting plan can be relatively lengthy. If there is doubt that a parenting plan or mediated settlement will be adhered to then work on some orders by consent.

In short my matter was adjourned for three weeks in the FMC as the respondent mother didn't submit her response and the FM thought I was wasting his time (IMHO). In short,the child lived with me for nine months to January. The child turns fifteen in June. The child didn't return form Xmas holidays as planned and contact since has been non existent. The mother has refused to enter into mediation (even though she started the process). I'm not sure how the next Mention will go. I felt I wasn't really given any opportunity to speak, however, I did know that I couldn't give evidence from the bar table. The FM wants to hear from the child but I don't know how or whenthat will happen or whether I'll get a copy of what the child has written. I'm questioning myself whether I wrote enough in the affidavit, bagged out the respondent too much in the affidavit or whether I should have referred to the FLA within the affidavit to state my position.In all honesty, I dont think the FM really read my material.I've got three weeks to prepare (again). As the child will be 15, I know I'm on a hiding to nothing. However, I think it's in the best interest of the child that a male role model should guide him through adolescent life, even if it only is part time. The point being that the other parent encourages and facilitates contact, which is not happening and I know the reason why (it's all about the cash). That aside, Section 60CC is not being adhered to by the other parent and that's what I'm holding my argument on...Best interest of the child and facilitate contact with the other parent. If the FM goes for this, at least I have a bit of a moral victory whether the child co-operates or not. I'm not a Disney dad, far from it. There are rules in my house, no rules in hers. This email was a cry for help sent out by Wayne Butler to a very interesting group of people looking for something to say in response to proposed changes to the Family Law Act and in particular the issue of Domestic violence to women and children. The obvious question needs to be asked. Why if they are concerned about violence and cry louder than anyone how just as many women as men are victims, do they want to issue a Press Release about the issue?. If they genuinely cared about the children surely they would be marching in the streets about Domestic Violence too? Surely if as they say, as many men as women were affected by Domestic Violence, they would be demanding the government provide more money and services? But they're not are they? Maybe they're not telling the truth?
Some very interesting people were sent this email as well and gives the reader insight into who is really not supportive of programs to protect women and children including some government representatives. The SunHerald is also on the list and it was they who printed Simon Hunt's bogus story about his daughter.

Good to see this initiative in response to what is clearly a crisis for children and their fathers in this country.

Shared parenting after separation / divorce is being attacked on the basis that its unsafe for women and children.

These people - the industry - are making a national call for children to be denied there fathers if they are being accused of "Family Violence" (in all its forms) regardless of whether or not it can even be proved. I thought everybody knew that allegations of DV were standard procedure in the great majority of Custody hearing before the Family Court. The lawyers have been telling us this for years.

I've been saying for some time that we need public forums - public meetings that give the media access to the truth of whats going on. Looks like we've been beaten to the line, by organisations that can so easily engineer publicity and media support.

However, our advantage is truth - very powerful but it needs to be exposed. We need public meetings with speakers URGENTLY

The media needs access to the truth of whats going on - at present they have next to no access to the truth, mainly because they rely on the press releases they get from vested interest (including "experts) in the industry and are no longer paid to do 'investigative journalism'.

The revelation of the true extent of child pornography has shocked all Australians. The fact that community leaders such as teachers, school principals, ministers, policemen, childcare workers, doctors and solicitors have been purveyors and purchasers of such material is almost beyond belief.

The National Fatherhood Coalition calls upon Mr Howard and Mr Latham to bring in mandatory filtering of internet pornography. It also sees a desperate need to further protect our children by legislating against X-rated videos, already available in the ACT and Northern Territory.

It seems that Australia is fast following in the footsteps of the decadent Roman Empire. Philo of Alexandria (approx 20BC – 40AD) recorded the spread of paedophilia in the Roman Empire during the time he lived; ‘Moreover, another evil, much greater than that which I have already mentioned, has made its way among us and been let loose upon cities, namely, the love of boys, which formerly was accounted a great infamy even to be spoken about’.

Analysis of a report on child sexual assaults in NSW showed that the rate of sexual assaults by male heterosexual paedophiles in NSW on female children is horrific. But it also showed that the rate of sexual assaults by male homosexuals and male bi-sexuals on young boys was about 15 times worse!

Warwick Marsh from the National Fatherhood Coalition said today, “We, as men. Must accept that we have been part of the problem because we have refused to make a stand against pornography. The time has now come to say, ‘no more’. Our society and media has been obsessed with sex. Sex is a wonderful thing with the intended moral boundaries heterosexual marriage . If we don’t make a stand our society will sink further into the moral quicksand and paedophilia will become accepted. The role of paedophilia in the decline and fall of the Roman Empire is a warning to our society that our children will become the victims of a much greater evil.

Barry Williams from the Lone Fathers Association said that exposing our children to high risk groups through homosexual adoption was not the way to go because our children need our protection. It is a plain fact that children need a mother and a father, not two daddies or two mummies. Study after study has shown that the safest place for our children is with their biological mother and father. How much longer must our children wait?

Mediators not acting properly

We can't wait to see what Michael Green thinks about the following post to Familylawwebguide. When you're lodging your complaint "One" you might want to ask how Michael Green can run a Family Law Mediation service when he is President of a Mens Rights Group.

One wrote:

"I had three mediation sessions with my child's mother with the last being at the end of last year. Recently I sought further mediation. After visiting the FDR office and giving my reasons for seeking mediation an appointment was made. I then received a message from the centre's secretary stating 'the mediator says this is not a matter suitable for mediation'. After questioning why i received a call from the mediator. I was told that the file had been closed some months ago and since then a conflict of interest had arisen. The mediator said he had been 'connecting with the other party on a social basis, over coffees and such'. He said the initial reason given was motivated by a desire to keep his social life private(from his secretary). To quote him ' i tried to fob you off earlier'. As it turns out the term 'socially' is a gross understatement. I have been looking for advice on where to go from here and getting answers initially proved frustrating. I find myself questioning the entire mediation process. I wonder whose interests have been served. My questions centre around whether a mediator can be involved with a party socially after the mediation process has been closed. I was not informed it was closed. I was not informed further mediation was no longer possible. Obviously the other party must have known these details. The reasons for seeking further mediation are sensitive and I am appalled that the ex-mediator has knowledge of their nature due to having to say why I wanted further mediation when applying. Also the mediator and myself had a prolonged discussion about my reasons for wanting further mediation... he told me that he could still give impartial advice. on a surface level I trust that confidentiality wont be broken. However, recent changes in the other party's behaviour have led me to conclude that she is receiving advice on how to act. At first i found these changes reassuring and I believe the mediator is trying to help. The reality is this advice weakens the chances of effectively resolving the issue that led me to seek mediation. The surface level confidence might be easy to live by but how can anyone say that they wont apply the information they possess on a more subtle level, or make a 'slip'. I sought advice and consequently sent a letter to the mediator and another to the director of his organisation."

Is having a young family of our own strong enough grounds as this effects our child too now not just us? All we are seeking is the truth.

Lindsay Jackel Supports Black Shirts

The Black Shirts were a so called Fathers Rights crackpot group originating out of Melbourne Victoria (also where Lindsay Jackel lives) and decided to run a terror campaign of stalking and harassment against any women they heard had left her husband. The leader John Abbott was found guilty in court. They were exposed as a crank group and a simple Google search will reveal the lack of mental stability for anyone involved in the group.

Here Lindsay Jackel, Victorian Director of the Shared Parenting Council, executive of SRL and Dads On the Air makes a post on DOTA forum supporting the stance of the BLACK SHIRTS.

Ex QC Jailed for Child Porn

A RETIRED Victorian senior barrister will serve six months behind bars after pleading guilty to child pornography offences.

Neil James Williams, of Newham in central Victoria, was charged with single counts of using a carriage service to access child pornography, using a carriage service to transmit child pornography and knowingly possessing child pornography.

The retired Victorian Queens Counsel was arrested by Australian Federal Police (AFP) in October last year.

He was sentenced today by Judge Joe Gullaci in the Bendigo County Court and ordered to serve an immediate six-month jail term.

He will then be released on a recognisance order to be of good behaviour for 18 months.

Williams was among 19 men arrested in Australia by the AFP as part of a 12-month global child abuse investigation.

More than 15,000 videos and 500,000 images of child abuse - described by police as among the worst they have seen - were seized in the investigation.

The images and videos, which captured the sexual abuse of children, were shared between members of an online network.

What is the Shared Parenting Councils Relationship with the Child Support Agency?

Wayne Butler is constantly referring to his special relationship with the Child Support Agency and implying that he can exert a lot of influence with that department? Mike Taylor has also referred to the special arrangement. We would like to know what is the nature of that arrangement and all that it entails. Is the Child Support Agency aware that the Shared Parenting Council of Australia really is just a rebadged Mens Rights group who have every interest in avoiding the payment of Child Support. Surely they have read the majority of the posts on the forum Familylawwebguide that are mainly concerned with the minimisation and avoidance of Child Support liabilities? Why are they still involved as a participant ont he site then? Why have they not admitted the bias towards payees and withdrawn their participation from the site? So many questions.

Lindsay Jackel Airing his dirty Laundry in Public

Lindsay Jackel wrote in a submission to the Government:

"It is wrongly claimed that because a father may not agree with a mother that he will abuse his children. This is not true. Children are safer with their separated fathers than with their separated mothers. There is an increased risk of hurt and harm for children living with separated mothers, both from the mother herself and form her current partner. This risk is greater than if they were living with their father and his new partner. One of the writers of this submission has firsthand knowledge of this, with his 13 year old daughter being slapped by the mother’s female partner, resulting in the father being called to come and remove the daughter from that explosive situation until it was safe for her to return to be with her mother."

It is a pity Lindsay Jackel did not have an Anti Denigration Clause added into his parenting Agreement to speak respectfully of his childs mother. (He changed the names from Lindsay and Susan in an attempt to disguise that it was his Parenting Plan that he wrote. It reveals a very controlling person.) Jackel has been spouting this plan around the Mens Rights groups for many years. Jackels daughter has Aspergers. Jackel has also witten several very spiteful things about his ex wife and posted her personal information on various Christian, Mens Rights and homosexual forums, including the fact that she ran off with another woman.

1. Residence/Residence
a. That the daughter of the marriage of Daniel Peter Jones and Vanessa Lee Jones, Mary Elizabeth Jones (Mary), born 19 February 1990, reside alternately, one week with Daniel and one week with Vanessa;

That the commencement of each week (of residency) start on the Friday afternoon after school at the River Valley Primary School (No. 1234), Whites Lane, Riverview, New South Wales, with the residential parent meeting Mary at either her classroom at 3:30pm or subsequently at the After School program prior to 6:00pm;
c. Where 'residential parent' is defined as "the parent with whom Mary is currently residing in terms of this parenting plan, particularly in relation to the alternate weekly residence" and 'non-residential parent' is defined as "the parent with whom Mary is not currently residing in terms of this agreement, particularly in relation to the alternate weekly residence";
d. That a diary be jointly purchased, by Daniel and Vanessa, and used to maintain a record and notice of Mary's residency, activities, commitments, health and the like, and that that diary accompany Mary between her two homes;
e. That Mary not reside for more than two days with a third party on behalf of either Vanessa or Daniel without the consent of the other parent, except in the case of a legally married spouse of either Daniel or Vanessa, in accord with the Marriage Act 1961 of the Commonwealth of Australia as amended, or as otherwise agreed for contact as specified in this parenting plan;
f. That in the event of the death of both Daniel and Vanessa, it is intended that Mary reside with the family of one of Daniel's brothers (Alan Samuel Jones or Andrew Ross Jones) in the order outlined in this paragraph or as otherwise determined by them, and after consultation with Mary and due regard for her stated wishes, and that Mary not be excluded from contact with her maternal family;
g. That there be scope for variation of Mary's time residing with either parent following agreement (preferably written agreement but not limited to written agreement) between both parents, and allowance for flexibility and goodwill in living arrangements, in order to maximise the attainment of Mary's best interests, on such other terms as agreed between both parents; and
h. That this residency order commence on or before, but no later than, the afternoon of Friday 25 April 1997, with Mary residing with Vanessa for the week so commencing.
2. Residence/Contact
a. That Mary reside alternately, one week with Daniel and one week with Vanessa, and have contact with the non-residential parent during the course of each week to allow for her participation in ongoing activities and arrangements, both current and new (such as swimming lessons, German language classes, family, social, music and sporting activities and the like);
b. That the non-residential parent be entitled to be the primary provider of childcare for Mary, and be primarily offered the first option to care for her, when the
residential parent requires care for her at any time, particularly in respect to occasions requiring overnight stays;
c. That both Vanessa and Daniel encourage and facilitate Mary's contact with the non-residential parent via telephone calls, written correspondence, occasional non-scheduled visits and the like on a regular basis, and that each parent may initiate reasonable such contact with Mary;
d. That Mary have contact with each parent for half of each school term holiday period and for half of the Christmas school holiday period of each year, subject to paragraphs (e) and (f) below, or other such arrangements as agreed between both parents;
e. That Mary have contact with both Daniel and Vanessa on Christmas day for half a day each, with Mary spending the Christmas morning of 1997 with Vanessa and the afternoon with Daniel (with a change over at 2pm, or as agreed), and alternately in subsequent years, or other such arrangements as agreed between both parents;
f. That Mary continue contact with her paternal grandparents (Peter James Jones and May Alice Jones, who currently reside on a farm at Bathurst, New South Wales) for a period of one week over the Christmas school holidays of each year, or other such arrangements as agreed between both parents;
g. That Mary have contact with her maternal grandparents (Patricia Robyn Newman and Richard Henry Newman who reside in Epping, New South Wales) via ongoing and regular short term visits whilst with the residential parent, and that these visits include no more than seven full nights of residential care with them, either in their domicile or any other domicile, except as agreed otherwise after discussion between both parents;
h. That consideration be given for Mary to have contact with the families of her cousins during school holidays, and at other times, as determined from time-to-time by the agreement of both parents;
i. That consideration be given for Mary to attend camps during school holidays, and at other times, as determined from time-to-time by the agreement of both parents;
j. That in the event of Mary's birthday occurring whilst she is residing with Vanessa then she shall, if her birthday occurs on a school day, spend three hours after school with Daniel, or, if her birthday occurs on a weekend or holiday, spend the morning with Daniel, or such other amount of time as agreed by Daniel and Vanessa. Wherever practicable a joint birthday celebration shall be organised at which both parents can attend and participate;
k. That in the event of Mary's birthday occurring whilst she is residing with Daniel then she shall, if her birthday occurs on a school day, spend three hours after school with Vanessa, or, if her birthday occurs on a weekend or holiday, spend the morning with Vanessa, or such other amount of time as agreed by Vanessa and Daniel. Wherever practicable a joint birthday celebration shall be organised at which both parents can attend and participate;
l. That Mary shall spend a minimum of three hours with Daniel, or such other amount of time as agreed by Daniel and Vanessa, when Daniel's birthday occurs whilst Mary is residing with Vanessa, and that Daniel shall meet and return with Mary to Vanessa;
m. That Mary shall spend a minimum of three hours with Vanessa, or such other amount of time as agreed by Vanessa and Daniel, when Vanessa's birthday occurs whilst Mary is residing with Daniel, and that Vanessa shall meet and return with Mary to Daniel;
n. That Mary shall spend time with Vanessa on Mother's Day from 10:00am until 5:00pm, or such other amount of time as agreed between Vanessa and Daniel, and that if Mary is residing with Daniel, Vanessa shall meet and return her to Daniel;
o. That Mary shall spend time with Daniel on Father's Day from 10:00am until 5:00pm, or such other amount of time as agreed between Daniel and Vanessa and that if Mary is residing with Vanessa, Daniel shall meet and return her to Vanessa;
p. That travelling for the purposes of contact be shared equally between Vanessa and Daniel, and that in situations of both regular and ad hoc contact that this be primarily on the basis of the non-residential parent seeking contact being responsible for meeting and returning with Mary at the home of the residential parent, with, for example, Daniel returning Mary to Vanessa's residence on the Monday evening of Mary's residence with Vanessa, after German language
classes, and Vanessa returning Mary to Daniel's residence on the Thursday evening of Mary's residence with Daniel, after swimming lessons, or otherwise as agreed;
q. That in the event of illness and/or medical treatment of Mary, Daniel or Vanessa that Mary’s place of residence be varied by agreement between Vanessa and Daniel to flexibly manage the situation for Mary's best interests;
r. That consideration and allowance be made, as agreed by Vanessa and Daniel, for Mary to have contact on public holidays (eg. Australia Day, Moomba, Anzac Day, etc. commemorations and celebrations), Show Days and the like, with either or both parents, flexibly for varying amounts of time, regardless of residency, allowing for, but not mandating, joint participation of both Daniel and Vanessa, and for ad hoc contact for special days and events, and family, party, and social activities and outings of either Vanessa or Daniel;
s. That allowance be made, by prior agreement, for Mary to spend compensatory contact time with one parent in situations where she has spent additional time with the other parent; and
t. That contact be exercised equally, flexibly and with goodwill overall, and at such other times and on such other terms as agreed between both parents.
3. Specific Issues
a. That Mary reside alternately, one week with Daniel and one week with Vanessa, and that Vanessa and Daniel share joint responsibility for decisions involving Mary's long term care, welfare and development;
b. That Daniel, in consultation with Vanessa, as required, have responsibility for the daily care, health and welfare, development of Mary during periods in which she is in his care;
c. That Vanessa, in consultation with Daniel, as required, have responsibility for the daily care, health and welfare, development of Mary during periods in which she is in her care;
d. That Daniel and Vanessa participate in and share equally and flexibly Mary's activities, in particular her health and schooling activities and programs, including her appointments with medical practitioners, dentists, counsellors and the like;
e. That both Daniel and Vanessa be informed of all matters of Mary's care, welfare and development, including such matters as friendships and social activities, church attendance and religious activity, education, extra-curricular activities (such music, language and swimming) health and wellbeing and the like, and have the opportunity to maintain an active involvement and ongoing role in caring for Mary, particularly in regard to her diagnosed condition of Asperger's Syndrome, or other such diagnoses as from time-to-time may be under consideration and in view;
f. That both Vanessa and Daniel encourage and facilitate Mary's contact with the non-residential parent via telephone calls, written correspondence and the like on a regular basis, and that each parent may initiate reasonable such contact with Mary;
g. That both Vanessa and Daniel be informed of, and have the opportunity to attend and participate in, the Program Support meetings conducted at Mary's school;
h. That the non-residential parent be entitled to be the primary provider of childcare for Mary, and be primarily offered the first option to care for her, when the residential parent requires care for her at any time, particularly in respect to occasions requiring overnight stays;
i. That both Vanessa and Daniel will keep each other informed (via the diary specified earlier in this document) of significant events occurring in Mary's life, in particular family, social, academic, health and medical, church, musical, sporting and the like;
j. That Mary continue to attend, with each parent, a Christian church on Sunday morning and, if either parent is unable or unwilling to continue doing so, either in the short or the long term, then that non-attending parent will make arrangements for Mary to attend a Christian church with the other parent on the Sunday morning when Mary is residing with the non-attending parent;
k. That changes of Christian belief and Christian church attendance, involving Mary, only occur after joint parental consultation and agreement, in writing, between both parents;
l. That no major medical procedures or operations be undertaken in relation to Mary without joint parental consent, unless in the case of an emergency requiring immediate treatment (within 3 hours), as advised by a legally qualified medical practitioner, and that all reasonable efforts be made to contact the other parent;
m. That Mary be permitted to attend the funerals of her close relatives, such as her grandparents (including her great grandmother), parents, uncles, aunts and cousins as a matter of course, and of her wider family, such has her parents' uncles, aunts and cousins by agreement between both parents;
n. That Mary continue to attend the River Valley Primary School until the completion of Year 6 at the end of 2001, with any variation occurring only after Daniel and Vanessa have jointly discussed, agreed and affirmed their written consent to the change;
o. That neither Daniel nor Vanessa relocate residence, in as far as this affects where Mary will reside and attend school, outside the Sydney metropolitan area or a distance of greater than thirty kilometres or thirty minutes travelling time in typical weekday non-peakhour traffic - whichever is the lesser, without providing the other parent with three months prior notice, unless the moving parent undertake and fulfil all transport for the purposes of residency and contact of Mary to the non-moving parent, so that neither Mary nor the non-moving parent are disadvantaged, unless otherwise agreed to and affirmed by the written consent of both parents;
p. That each parent inform the other, by providing the details, of changes of address and telephone number within 48 hours of such changes that affect where Mary resides and can be met for and returned from contact visits and contacted by mail and telephone;
q. That no significant costs or fees be entered into that would be the responsibility of the other parent, either in part or in whole, without the written consent of the other parent;
r. That Mary's full name shall not be changed, either by common usage or legally, without Mary's agreement and the written consent of both Daniel and Vanessa, or until the attainment of Mary's eighteenth birthday;
s. That Mary not be adopted by another person associated with either parent, nor anyone else, while both parents are living;
t. That neither Daniel nor Vanessa take Mary out of the State of New South Wales without prior consultation and the consent of the other parent;
u. That neither Vanessa nor Daniel seek to obtain a passport for Mary, nor take her out of Australia, without prior consultation and the written agreement of the other parent;
v. That both Daniel and Vanessa have equal entitlement to and share all originals and copies of Mary's achievement, educational, medical and other similar certificates, reports, school photographs and the like, with copies being made for the other parent where the original is held and, if any dispute arises relating to the location and ownership of such items, that a third person (such as a solicitor or trusted mutual person) hold them in trust for Mary until she is twenty one years of age, whilst allowing necessary access to both parents;
w. That both Vanessa and Daniel agree to speak respectfully of one another with Mary, to encourage her to understand that both her parents love her and to not discuss parental relationship issues with her, without the prior agreement of both parents, and that if there are such issues, both parents attend joint counselling with the aim of resolving the issues in Mary's best interests, either with a mutually agreed counsellor or otherwise as directed by the Family Court of Australia;
x. That in the event that issues arise concerning either parent's lifestyle, parenting style or other parent-related factors which may be detrimental to Mary's best interests that, after initial joint discussion, both parents attend joint counselling with the aim of resolving the issues in Mary's best interests, either with a mutually agreed counsellor or otherwise as directed by the Family Court of Australia; and
y. That specific issues be exercised equally, flexibly and with goodwill overall, and on such other issues and on such other terms as agreed between both parents.
4. Financial Issues
a. That Mary's day-to-day expenses for clothing and footwear, primary school education, (including Before and After School Childcare, with these childcare costs subject to review and negotiated and agreed change should the circumstances of either party change), extracurricular tuition (such as piano and swimming lessons), medical, dental and counselling, social activities (such as outings, parties and presents) and the like be shared equally by both Daniel and Vanessa and paid for jointly, with consideration made for any child support paid by either parent (as outlined in paragraph (b) below), and that such expenditure be discussed and agreed beforehand, as much as is practicable, or such other similar arrangements, as discussed and agreed in writing, as from time-to-time shall come into existence and operate for Mary's provision and welfare;
b. That where child support is paid by either Vanessa or Daniel, on Mary's behalf, either through the Child Support Agency or otherwise, and received from the Department of Social Security or otherwise, these monies shall, in proportion, be first used to pay the day-to-day expenses outlined in paragraph (a) above, and then any other expenses incurred for Mary's provision and welfare;
c. That, whilst Mary is eligible for a Child Disability Allowance, both Daniel and Vanessa have access to the Department of Social Security Health Care card issued on Mary's behalf, for the purpose of medical matters (eg. consultations, prescriptions, etc.) and to the funds, where required, for issues relating to Mary's health and welfare (eg. specialist appointments, counselling, etc.), and that equal sharing of any similar allowances or benefits occur as and when they are operable; and
d. That financial issues be considered and exercised with Mary's best interests in mind, and with equity, flexibility and goodwill overall, and on such other matters and on such other terms as agreed between both parents.
That liberty be granted to either party to apply for variation to this parenting plan order.

What the SPCA is really saying about the Child Support Agency

Peter Marsh State Director SPCA Qld said :

"The damage caused by the CSA Part6A review processes since 1997 has forced me and my children to suffer the effects of losing a home, losing the rented premises of ten years that my children knew, my career, my dignity, my health and my future prospects of self support and finally all contact between my children and myself. The CSA has been and still is the largest obstacle between myself and my children and the largest impediment to the future of my children and myself." Subsequent to these events, and what I can only presume to be out of spite xxxxxx wrote to me falsely portraying that I has resigned from the RAP meetings. Suffice to say, I was never invited back and the most senior of officials had orchestrated my removal as a community representative and stakeholder in the operation of Child Support in this country. These factors are an identifier of the endemic culture of the CSA and throw weight to the proposition that the CSA should be xxxxxxand should be xxxxxxxxxx removed from office and the CSA dismantled. "Catherine Argall and Shiela Bird of the CSA should be sacked from the public service and prevented from holding a position in the public service again."

Coral Slattery (Nemos Mum on Familylawwebguide) and Executive of Shared Parenting Council of Australia, SRL Executive and Executive of Family Law Reform Association says that it is rare for men now to be accused of sexually molesting their children in Family Law matters.

I’m sorry to be so late in answering your last email regarding comments made by Michael Green, Q.C.

Michael Green played an integral part in the Family Law reforms which were recently introduced into Australia and endorsed by our association. These innovative reforms have made it possible to move away from litigation and the court system with the introduction of 64 Family Relationship Centres throughout Australia, whose main focus is to encourage the use of early intervention through free counselling and mediation. From my understanding, less than 5% of cases now end up in the Family Court.

Might I add that we’ve now had the opportunity of looking back over three decades to see the damage done to children when parents are consumed by their own situation. Many of the children who have experienced family breakdown have grown up living in poverty because of the exorbitant costs associated with litigation and have been totally alienated from one half of their extended family, not to mention the social costs. This is why it is imperative that we do all we can to keep couples out of the Family Court where a judge will make a decision, rather than an agreement between the parents. We recognise the fact that changing the culture of marriage breakdown won’t happen overnight; in fact, it may take a decade for separating couples to realise that the welfare of their children is their first priority.

I note that you mentioned the case of Hal Ginges, a solicitor in Katoomba. Hal spoke at one of our meetings about 10 years ago on child sexual abuse allegations and we are fully aware of his case. We hold monthly meetings and I can say it is rare these days that we have anyone attending who has been accused of child sexual abuse. A few years ago it seemed to be the “norm” following marriage breakdown, but the courts have now tightened up on those allegations.

I hope that my comments are helpful to you in understanding what we’re trying to achieve. These are my own personal views, but would be endorsed by the majority of our members. Things are changing here in Australia and we’re optimistic about the future for family law reform. Our aim is to keep separating couples out of the Family Court and into counselling and mediation. However, it would be naïve of us not to recognise the fact that “one size does not fit all” and inevitably there will always be cases which have to go to the Family Court.

The Shared Parenting Council members including Michael Green, Wayne Butler and Barry Williams have the following advice published on their website, familylawwebguide where they advise payers of Child Support to use "foul means" to resist responding to a Change Of Assessment for Child Support payable to support their children.

And keep your CSA paymnets up to date if you can - because when you win on a point, a refund cheque is a badge of honour.
