SPCA Views on Homosexuality

Interesting article on what the Shared Parenting Council think about Homosexuality. It's the Festival of Light magazine and details how the FOL are a part of the Shared Parenting Council of Australia.

Shared Parenting Council of Australia Closing Down!!

Wayne Butler from the Shared Parenting Council of Australia has announced that because they have been unable to obtain funding that they will be closing down. Unsuccessful attempts to secure government funding has meant that they are unable to proceed with planned Contact Centres.

The woman and children of Australia can all breathe a sigh of relief although they should remain on alert because like cockroaches, these vermin will not be eradicated.

Child protection experts say it's time Australia's child custody laws put children's rights before those of squabbling parents.

The Federal Government is reviewing the controversial Howard-era shared parenting laws which forces courts to consider joint custody, and frantic lobbying by interest groups has already begun.

Chairman of the Government's peak family law advisory body, the Family Law Council, Professor John Wade, said shared-parenting rules risked creating a generation of ''ping-pong children'' being shuttled between warring parents and needed to be changed.

The laws are subject to an automatic review carried out by the Institute of Family Studies this year, and battle lines are being drawn between the increasingly influential parents' lobby groups.

Some parents groups have welcomed the news of the possible changes, but fathers' rights campaigners, who lobbied for shared parenting for more than 25 years, have vowed to fight for the retention of the laws.

Under the current laws, the court's default position in relation to custody is an equal and shared parenting arrangement if it is deemed in the best interest of the child.

Child defence expert witness Charles Pragnell says children are often being placed in dangerous situations by courts forced to consider shared parenting, and gave the recent example of a Melbourne court ordering that an 18-month-old spend alternating weeks with each parent.

''That will have a tremendously traumatic effect on that child, and cause severe and long-lasting emotional harm,'' he said.

''Children of that age and older need a sense of belonging, consistency and security.''

He referred to several high-profile cases where courts had placed children in danger with tragic consequences, such as four-year-old Darcy Freeman, who died after her father threw her off Melbourne's West Gate Bridge in January.

''The law is concerned about parents' rights, and gives very little account or regard for children's rights, even those children's rights under the UN Convention to which Australia was a signatory in 1991, but hasn't done very much about,'' Mr Pragnell said.

''Children's rights in this country are appalling compared to the UK and European countries.''

A spokeswoman for the National Council of Shared Parenting agreed that the current family laws gave priority to the parents, rather than their children.

She said when one or the other parent was forced into a custody arrangement, this often created unsafe or unhappy environments for their children. ''How do children get protected in all this? Their rights are being forgotten and not heard,'' she said.

''It's an awful situation, and it's made awful by the fact that it's so preventable.''

But Lone Fathers' Association President Barry Williams vowed that the fathers' movement would lobby hard to retain shared parenting.

''We've called for an appointment with [Attorney-General] Robert McClelland, and I'll be taking quite a few people from quite a few different organisations,'' Mr Williams said.

''We're going to try to convince him not to take any notice of this rot that's being put out by people with vested interests.

''In cases that we deal with, the children are quite happy and they like the shared parenting arrangements.

''We had 30 years of the old system when hundreds of thousands of children never saw their fathers.''

But one Canberra family lawyer, who did not want to be named, said one of the most frustrating aspects of the law was seeing a parent, usually a father, who had previously had little role in caring for his children and had showed no interest in their wellbeing, suddenly demanding shared custody.

She said the motivation was usually increased child support

Here Wayne Butler and Lindsay Jackel of the Shared Parenting Council of Australia comment on a recent court case that gave custody to a man that wasn't even a childs natural parent and denied the mother.

Oh Wayne and Lindsay why aren't you outraged? This is not Shared Parenting? Why aren't you jumping up and down and screaming from the rooftops about the injustice? This email was a cry for help sent out by Wayne Butler to a very interesting group of people looking for something to say in response to proposed changes to the Family Law Act and in particular the issue of Domestic violence to women and children. The obvious question needs to be asked. Why if they are concerned about violence and cry louder than anyone how just as many women as men are victims, do they want to issue a Press Release about the issue?. If they genuinely cared about the children surely they would be marching in the streets about Domestic Violence too? Surely if as they say, as many men as women were affected by Domestic Violence, they would be demanding the government provide more money and services? But they're not are they? Maybe they're not telling the truth?
Some very interesting people were sent this email as well and gives the reader insight into who is really not supportive of programs to protect women and children including some government representatives. The SunHerald is also on the list and it was they who printed Simon Hunt's bogus story about his daughter.

Good to see this initiative in response to what is clearly a crisis for children and their fathers in this country.

Shared parenting after separation / divorce is being attacked on the basis that its unsafe for women and children.

These people - the industry - are making a national call for children to be denied there fathers if they are being accused of "Family Violence" (in all its forms) regardless of whether or not it can even be proved. I thought everybody knew that allegations of DV were standard procedure in the great majority of Custody hearing before the Family Court. The lawyers have been telling us this for years.

I've been saying for some time that we need public forums - public meetings that give the media access to the truth of whats going on. Looks like we've been beaten to the line, by organisations that can so easily engineer publicity and media support.

However, our advantage is truth - very powerful but it needs to be exposed. We need public meetings with speakers URGENTLY

The media needs access to the truth of whats going on - at present they have next to no access to the truth, mainly because they rely on the press releases they get from vested interest (including "experts) in the industry and are no longer paid to do 'investigative journalism'.

Coral Slattery says Child Sexual Abuse Allegations are RARE!

Coral Slattery (Nemos Mum on Familylawwebguide) and Executive of Shared Parenting Council of Australia, SRL Executive and Executive of Family Law Reform Association says that it is rare for men now to be accused of sexually molesting their children in Family Law matters.

"Dear Michael

I’m sorry to be so late in answering your last email regarding comments made by Michael Green, Q.C.

Michael Green played an integral part in the Family Law reforms which were recently introduced into Australia and endorsed by our association. These innovative reforms have made it possible to move away from litigation and the court system with the introduction of 64 Family Relationship Centres throughout Australia, whose main focus is to encourage the use of early intervention through free counselling and mediation. From my understanding, less than 5% of cases now end up in the Family Court.

Might I add that we’ve now had the opportunity of looking back over three decades to see the damage done to children when parents are consumed by their own situation. Many of the children who have experienced family breakdown have grown up living in poverty because of the exorbitant costs associated with litigation and have been totally alienated from one half of their extended family, not to mention the social costs. This is why it is imperative that we do all we can to keep couples out of the Family Court where a judge will make a decision, rather than an agreement between the parents. We recognise the fact that changing the culture of marriage breakdown won’t happen overnight; in fact, it may take a decade for separating couples to realise that the welfare of their children is their first priority.

I note that you mentioned the case of Hal Ginges, a solicitor in Katoomba. Hal spoke at one of our meetings about 10 years ago on child sexual abuse allegations and we are fully aware of his case. We hold monthly meetings and I can say it is rare these days that we have anyone attending who has been accused of child sexual abuse. A few years ago it seemed to be the “norm” following marriage breakdown, but the courts have now tightened up on those allegations.

I hope that my comments are helpful to you in understanding what we’re trying to achieve. These are my own personal views, but would be endorsed by the majority of our members. Things are changing here in Australia and we’re optimistic about the future for family law reform. Our aim is to keep separating couples out of the Family Court and into counselling and mediation. However, it would be naïve of us not to recognise the fact that “one size does not fit all” and inevitably there will always be cases which have to go to the Family Court.

It is very concerning to see Michael Green head up the Self Represented Litigants Club because he is not allowed to practise law without a current certificate which he doesn't have (easy to check this one) so therefore he is breaking the law.

It has been said by various people who have vigourously tried to deny that the SRL are a part of the Shared Parenting Council and were set up long before familylawwebguide was set up but this list available from an online cached version of the site clearly says that the SRL main players are ONLY members of SPCA. There is only one group controlling the lot and that is SPCA. All of the names are of militant mens rights campaigners and not one of these people are aligned with mothers, women or families. They fight for mens rights. Peter Saxon you are a liar. Anyone be very wary about giving your details to any of the SRL, we have evidence where they used that information inapropriately and the matter is currently under investigation. Re: Appointment of Mr Barry Williams as men's health ambassador

I write to you to express our concerns about the controversy surrounding Mr Barry Williams, who has recently been appointed to the position of men's health ambassador as part of the Federal Government's dialogue on men's health issues. We have noted that you have sought assurances from Mr Williams about a document published by the Fatherhood Foundation, in which he is mentioned as a co-author -- 21 Reasons Why Gender Matters -- and we understand you are satisfied with his response that he does not support the contents of that document and repudiates it.

However, we wish to bring to your attention other activities of Mr Williams which may be even more problematic than the aforementioned document.

In the first instance, we wish to refer you to a leaflet published by the Fatherhood Foundation for a forum entitled Dads4Kids. The leaflet is available on the internet at:

This document purports to be a forum organised in June 2008 to oppose the Same Sex Relationships Bill 2008, which at the time was before the NSW Parliament. It is clear that this document indicates it is an anti-gay rally designed specifically to stop the passage of equality legislation in NSW and therefore perpetuate the stigmatisation and hurt of same-sex couples in that jurisdiction.

Among the speakers listed for this anti-gay forum is Mr Barry Williams.

In the second instance, we wish to refer you to a document published by National Marriage Coalition (incidentally, set up by the Fatherhood Foundation and others), in which Mr Williams is mentioned as a signatory to the documents -- The National Marriage Manifesto and the document in the appendix, titled 21 Reasons Why Marriage Matters. This document echoes much of the 21 Reasons Why Gender Matters document and is misleading, offensive and anti-gay.

An example of the misleading propaganda and 'statistics' used in this document is demonstrated at page 17. There is reference to an Australian study of primary school students claiming the reason for poorer educational and health outcomes of children of gay parents is because their parents are gay. However, the study's author attributes the result not to the sexuality of the parents, but the inherent anti-gay attitudes of society towards the children by homophobic individuals and institutions (quoting the study's author, Sotirikos Sarantakos, describes in his book Same-Sex Couples:

"It is difficult to accept that living in a family environment that is condemned by the community, in which homosexuals and their children are subjected to discrimination, disadvantage, negative criticism, humiliation, harassment, embarrassment, exclusion, hostility, injustice and media bashing, offers as good a place to grow as that of heterosexual relationships."

This is just one example of the misleading, deceptive, anti-gay comments in this document.

We also note that the document 21 Reasons Why Marriage Matters has now been formulated into a glossy brochure. It is online at:

Mr Williams is a signatory to the National Marriage Manifesto and 21 Reasons Why Marriage Matters document.

In the third instance, we wish to refer you to the Lone Fathers Association's journal, in which Mr Williams gives ample publicity to Mr Marsh's Fatherhood Foundation's anti-gay activities. An example is contained in this edition, available online:

This publication gives a report (see pages 28-30) of the aforementioned anti-gay rally against the NSW Same-Sex Partnerships Bill, at which Mr Williams was purported to be an advertised speaker.

Indeed, the newsletter report in the Lone Fathers Association newsletter contains the following claim about the NSW Bill:

The Bill promotes homosexual marriage and homosexual adoption and as such promotes ill health and gender disorientation pathology. It would be similar in effect to the state government subsidizing and encouraging smoking, a proven unhealthy lifestyle choice. No government should ever actively promote ill health.

This is anti-gay and offensive. Further, the newsletter report goes on to thank a number of organisations, including the Lone Fathers Association for their actions in opposing the Bill:

In particular the Fatherhood Foundation would like to thank: Shared Parenting Council, Dads in Distress, Lone Fathers Association, Reforming Alliance, Festival of Light, Australian Christian Lobby, Australian Family Association, Marriage and Family Office, Equal Parenting Party, GRANS and many others too numerous to name including many wonderful pro-family state parliamentarians

Minister, our organisation believe these actions warrant further investigation by your Department as to Mr Barry Williams' activities and his linkages to the Fatherhood Foundation's anti-gay activities.

We believe that Mr Williams' behaviour has been offensive to the GLBTI community, and his continued service as men's health ambassador is unacceptable given his activities.

We urge you to again contact Mr Williams and ask for an urgent explanation as to his activities, namely:
1) His activities at the anti-gay Dads4Kids forum, opposing the NSW Bill to provide equality for same-sex couples, in June 2008.
2) His activities with the anti-gay National Marriage Coalition, signing their Marriage Manifesto document and the attached appendix 21 Reasons Why Marriage Matters
3) His activities within his own organisation's newsletter, providing space for virulently anti-gay statements relating to the anti-gay Dads4Kids forum, as published in the August-September 2008 of the Lone Fathers Association's newsletter.

Similarly, we urge you -- after receiving Mr Williams' response -- to make another determination as to his suitability for the position as ambassador for men's health, and advise our organisation accordingly of the findings of your investigation and the outcome of your decision.
